e. 還是覺得以下見解沒什麼錯：
中標法第七條所謂之 ｢職權命令｣ 和 ｢授權命令｣，應僅為對行政機關所為各式法規命令所言，其中並不包括行政規則；理由有三：
1. 中標法第七條明言上開命令除下達、發布外，須即送立法院，當然解為該命令須有明列其法律授權之依據之必要；根據行程法 150-II 規定，法規命令應明列其法律授權之依據，而行政規則或依 ｢重要性理論｣ 被歸類為 ｢不必保留｣ 之對於不特定人所為之行政命令等並無上開規範 (行程法 159-162)，故可知其所規範者僅純為法規命令。
2. 以法律體系言，中標法應為普通法，而行程法中關於 150~158 為就法規命令之特別規定，競合時應以具特別法性質之法規為優先適用 (中標法 16)。
3. 中標法制定時 (59/08/31)，尚無行程法 (88/02/03)，自然無法預料行程法對日後行政行為中 (其中除上述命令規則外，尚有行政契約、行政計畫、行政指導) 其他相關命令發布適法之可能程序，故行程法中所謂的行政 ｢規則｣，屬性與中標法 3、 7 所規範所謂之具有 ｢命令性質的規則 (法規命令的別稱)｣ 實在不同，內容不符，非為中標法該條所適用，洵屬自然，實無必要強為納入，或將有扞格之嫌。至於日後中標法如何能作統整性之解釋與涵攝，乃修法技術問題，此屬另一主題，自當別論。
